GENERAL GUIDELINES
This User's Guide, issued by B.C. "Moldindconbank" S.A.
establishes the way of using Moldindconbank MasterCardBusiness card
by an authorized Cardholder. It is issued under requirements of
NBM Regulations no. 58/11-02 of June 22, 1997 on organization of
card transactions by banks within the Republic of Moldova, NBM Regulations
on currency control within the Republic of Moldova of January 13.1994,
Regulations of Europay International and all applicable laws of
the Republic of Moldova.
Wherever used in this User's Guide or any other documents arising
hereunder, the following terms have the following meanings:
Agreement
The agreement concluded between the Applicant and the Bank for
the purposes of issuing the card and establishing card using conditions
as well as opening and maintaining accounts for all operations
with cards issued by B.C. "Moldindconbank" S.A. The
agreement consists in Application, and the User's Rules, and it
becomes automatically valid at the moment of Application approval
by the Bank.
Application
A document (an integral part of the Agreement) filled in by the
Applicant in order to obtain a card.
User's Rules
User's Rules (an integral part of the Agreement) governs usage
of cards and can be changed from time to time.
Bank
Card Issuer: B.C. "Moldindconbank" S.A., 38, Armeneasca
Street, MD 2012, Chisinau, Republic of Moldova.
Issuer
The Bank participating in a card payment system, either the owner
of respective card brand name or the bank with the rights to issue
cards with respective brand arising out of mutual obligations
with the owner of respective brand.
Basic Cardholder
A legal entity (trade company/institution) on behalf of which
is opened a card account bound by mutual obligations with Issuer.
Authorized User
A person, an employee of trade company/institution, appointed
by the Basic Cardholder as an Authorized User of card Moldindconbank
MasterCard Business.
Cardholder
A Person for which was issued the card Moldindconbank MasterCard
Business.
Card
The card Moldindconbank MasterCard Business - an international
card issued by B.C. "Moldindconbank" S.A. for employees
of a trade company/ institution (Authorized Users) in order to
pay for goods/services or to draw money through cash dispensers.
The Card is a standardized support of information, secured and
individualized, used by a cardholder in compliance with mutual
obligations with the card's Issuer and it is accepted by the trader
as a tool of payment for purchasing goods, services, drawing cash
money and performing other services of cash dispensers or pay-offices.
PIN
Personal Identification Number is generated in the system through
computer and it is assigned to a Cardholder for using in card
transactions. The PIN is an alphanumeric confidential code, which
can be used to check the cardholder's identity. The PIN is considered
the electronic equivalent of cardholder signature and it is used
as a security tool.
Card Account
An account that is opened and maintained by Bank on behalf of
Basic Cardholder, on which all card transactions as well as fees,
charges and all related expenses are debited/credited.
Fees and Commissions
The fees and charges related to card operations which are set
forth in Bank's Terms and Conditions.
Depositary Terms and Conditions
Depositary Terms and Conditions elaborated and approved by Bank.
Trader
A legal entity or an individual, which according to mutual obligations
with trader's bank is accepting cards, used in right way, as a
payment tool for purchasing goods and services.
Card Transaction
A transaction, when a card is used to pay for goods/services or
to draw cash. All transaction will be performed according to currency
regulation provided by legislation of Moldova and rules established
by Basic Cardholder.
ATM
A machine (Automatic Teller Machine) used to draw cash from a
card account and to perform other functions.
POS-terminal
A device installed at the places of selling or providing services
for taking, collecting and sending information on card payments
through electronic means.
Imprinter
A mechanical device originating the bill on paper by taking imprints
from element made on embossed card side.
Record of Charge
The primary evidence represented by a bill or receipt and filled
in by the trader, which confirms performing of card transaction.
It is very important that User's Rules to be well learned and applied
exactly in order to avoid potential negative results.
Note: filling and signing Application to issue
the card involves absolutely to know and accept User's Rules.
USER'S RULES
Using of card and PIN code
The card and PIN must be used by Cardholder in strict compliance
with User's Rules. The Cardholder will find out its PIN-code from
PIN-envelope received in the same time with card from Bank representative.
It is prohibited to disclose your PIN to any other persons.
Upon giving PIN-code to Cardholders Bank limits its responsibility
to the situations stipulated by User's Rules.
The Bank will issue a card Moldindconbank MasterCard Business
for an Authorized User on a written notice from the Basic Cardholder.
Any card issued in name of an Authorized User can be canceled
based on a written notice from the Basic Cardholder addressed
to Bank with annexed card or based on card restitution to the
Bank.
The Bank will issue the card to Client collecting of all fees
according to the Bank's Fees and Commissions, including enrollment
charge.
On receipt, the card will be signed with a ballpoint pencil
on a special reserved spot on the backside.
The card cannot be transferred. It shall be used only:
by the Cardholder;
in accordance with User's Rules;
during the validity period written on the card;
in compliance with the Bank's right at any time without
prior notice to refuse any request for authorization, reject
the issuance of a new card or its replacement, without obligation
to explain such rejection.
The card will be used to:
draw cash money at Bank ATMs or other representatives of
card payment system;
make transactions for purchasing goods and services from
trade companies (shops, hotels, restaurants, and petrol stations)
which participate in Card payment system.
Using Card for purchasing goods and services, the Cardholder
shall check the correctness of the Record of Charge, i.e. card
number, the amount and the date of transaction, and sign the document.
The trader has the right to ask for card surrendering in case
the cardholder's signature does not correspond to the relevant
signatures on the card and Record of Charge.
The trader shall remit to Cardholder an example of such document.
The Cardholder shall keep the Record of Charge during two (2)
years from the date of issuing, in order to control and monitor
expenses on its card account.
Any trader can ask the Cardholder to show an identification
document at the moment of performing any card transaction (passport,
driver's license).
It is forbidden to use the card in "quasi-cash" transactions
(gambling, casinos, lotteries, opening deposit accounts, etc.).
The card remains the property of the Bank and it must be returned
immediately on demand. Such demand, if made, will automatically
lead to cancellation of the Agreement.
The Card must not be used after it is canceled or suspended.
The card can be canceled or suspended by the Bank in case the
agreement relations are stopped or the Cardholder declares the
lost or theft of the card.
Should the Cardholder violate the above-stated conditions he subject
to the legislation in effect.
Card Account
This Card Account is opened by Bank in USD currency.
Minimal amount to open a card account is stipulated by relevant
Terms and Conditions of B.C."Moldindconbank" S.A..
The Basic Cardholder authorizes the Bank to automatically charge
his/her card account with the full cost representing:
performed card transactions;
payment of due banking commissions, fees and interests;
equivalent of a fraudulent operation fulfilled by the Cardholder
or with the help of card as a result of stealing or losing
a card;
equivalent of all expenses (post, phone bill, etc.) performed
by Bank on behalf of Cardholder in connection with disputable
transactions (authorization, transfer).
The Cardholder has the right to put in a written protest for
the card transaction during seven (7) calendar days from date
of receiving the statement of account.
The Bank issues for the Basic Cardholder a monthly statement
of account containing information about initial balance of Card
Account, list of transactions of the relevant month and final
balance. The Basic Cardholder receives his statement of account
for the relevant month after the 10th day of the next month. The
Bank charges its commission for any additional statement of account.
Fees and Commissions
Bank's fees and other expenses related to card and
card account will be directly withdrawn from card account under
established tariffs of "Moldindconbank" S.A..
Interests
The interests accrued on the balance of the card account
represent the interest rate established in depositary conditions
of "Moldindconbank" S.A.
Issuance and renewal of cards
The Bank has the right within the validity if this
Agreement to issue, from time to time, new cards that will replace
existing cards, not requiring to fill in a new Application. Should
there are no modifications in the Agreement, utilization of new
cards is governed by User's Rules of this Agreement.
Cancellation of Agreement
This Agreement immediately will be canceled (without
releasing the Cardholder from any obligations arising out of performed
transactions) in case:
the Cardholder is going into liquidation procedure or a
part or all of his/her property, engagements or assets are
alienated;
the Basic Cardholder is adjudicated bankrupt;
the Cardholder is notified in written by the Bank about
violation of existing User's Rules.
the Bank can terminate the Agreement at any time and has
the right:
to cancel without notice, in case of non-compliance
with User's Rules, one or all cards issued or used under
the Agreement;
to reject the request for reissuing, renewal or replacement
of any card, without releasing the Cardholder from any
obligations arising out of performed transactions.
all cards issued by the Bank will be returned by the Basic
Cardholder at its request;
the Basic Cardholder has the right to terminate the Agreement
at any time (without releasing the Cardholder from any obligations
arising out of performed transactions) giving a written notice
to the Bank and returning the card/cards.
The cancellation of the Agreement becomes valid after all
cards issued hereunder are returned to and received by the
Bank, and all liabilities of the Basic Cardholder are fully
discharged.
PIN and Card Security
The Cardholder is not allowed to make any technical
changes in card security parts, which protects the card from physical
damages or to change any personalization elements. Should the
Card was damaged, it is declared as null and void and withdrawn
from circulation.
The Basic Cardholder shall undertake all necessary measures
to assure the security of card and PIN issued in his name or in
the name of any Authorized User. The User shall assume also all
necessary measures to assure the security of card and PIN have
been issued for him. It is prohibited to write the PIN code on
the card or any other document. The PIN code must be memorized
on receipt and the Bank document must be destroyed.
The Cardholder shall ensure authenticity of the information
given in the Application and inform the Bank about any change
in his address or name immediately.
The Basic Cardholder shall immediately report theft or loss
of the Card to the Bank (phone: 54 89 40). After oral communication
(phone communication) the Basic Cardholder shall confirm the
Basic Cardholder shall confirm theft or loss of the Card in
written. The notice related to such loss/theft of card shall
be remitted to any unit or branch of "Moldindconbank"
S.A. or mailed to the address: "Moldindconbank"
S.A., 38, Armeneasca St., MD 2012, Chishinau, Republic of
Moldova.
Until the Bank is receiving the written notice related to
lost/theft of card, the Basic Cardholder bears full responsibility
for unauthorized utilization of card resulted in the breach
of Agreement or User's Rules.
In case:
Cardholder's card is lost or stolen, the Cardholder
shall present all necessary information to the Bank and
assist in retrieving actions;
Cardholder's PIN is known by any other person or was
disclosed accidentally or in other way, the Cardholder
shall provide all necessary information to Bank concerning
such disclosure and return the card.
the card, previously reported as missing, is retrieved,
the Cardholder shall apply to the Bank for further instructions;
subsequent use of this card is prohibited
Change of Agreement
The Bank may change User's Rules from time to time.
Any amendment or supplement to User's Rules shall be announced
by written notice within thirty (30) business days before entering
into force.
Claim Resolution
Any claim arising from this Agreement shall be examined
by the Bank according to Regulations no. 58/11-02.
Finale Guidelines
In case a trader refunds any amount of money related
to any card transaction in favour of any Cardholder, his Card
Account will be credited with such amount.
The Bank provides authorization services 24 hours per day and
seven days per week.
Any information given in the Application can be used by the
Bank to identify any other services and products that can be offered
to Cardholder in future.
All information related to Cardholder is confidential and shall
not be disclosed to any other third party except legal authorities
and in conformity with the provisions of the legislation in effect.
